Terms of Service

These Terms of Service ("Terms") govern your access to and use of TickerTalk (the "Service"), operated by Kevin Ober, an individual sole proprietor based in the Commonwealth of Virginia, United States ("TickerTalk", "we", "us"). By creating an account or using the Service, you agree to these Terms.
1. The Service
TickerTalk provides portfolio tracking tools, a simulation arena, and a financial academy for educational and informational purposes. Nothing in the Service is financial, investment, tax, or legal advice. You are solely responsible for your own investment decisions.
2. Accounts
You must provide accurate information and are responsible for activity under your account. You must be of legal age in your jurisdiction to enter into these Terms. Keep your credentials confidential.
3. Acceptable use
- No unlawful, fraudulent, or abusive use of the Service.
- No attempts to disrupt, probe, scrape, or reverse engineer the Service.
- No infringement of intellectual property or privacy rights.
4. Subscriptions, billing, and Merchant of Record
Paid access to TickerTalk is available on a monthly ($9.99 USD / month) or annual ($99 USD / year) subscription. Subscriptions renew automatically at the end of each billing period until cancelled.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle collects payment, remits applicable taxes, and issues invoices. Your payment relationship for subscription fees is with Paddle, subject to Paddle's Buyer Terms.
You can cancel your subscription at any time from your account settings or via Paddle's customer portal. Cancellation stops future renewals; access continues through the end of the current paid period. See our Refund Policy for refund handling.
5. Intellectual property
The Service, including its software, branding, and content, is owned by Kevin Ober and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms and your subscription plan.
6. Suspension and termination
We may suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated policy violations. You may stop using the Service at any time by cancelling your subscription and deleting your account.
7. Disclaimers
The Service is provided "as is" without warranties of any kind, to the fullest extent permitted by law. We do not guarantee uninterrupted or error-free operation, or the accuracy of any market data or educational content.
8. Limitation of liability
To the maximum extent permitted by law, Kevin Ober's aggregate liability arising out of or relating to the Service is limited to the fees you paid in the twelve months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
9. Governing law
These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Virginia.
10. Changes
We may update these Terms from time to time. Material changes will be communicated in-app or by email. Continued use of the Service after changes take effect constitutes acceptance.
